1. ACCEPTANCE OF TERMS

1.1. These Terms and Conditions ("Terms") form a binding legal agreement between you ("User," "you") and Citizenship Test Australia ("we," "us," or "our") regarding your use of citizenshiptestaustralia.com.au ("Site").

1.2. By creating an account or purchasing a Premium Subscription, you expressly agree to these Terms. If you do not agree, you must cease using the Site immediately.

1.3. You represent that you are at least 18 years of age and legally capable of entering into binding contracts.

2. APPLICATION OF AUSTRALIAN CONSUMER LAW (ACL)

2.1. Our services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"), set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

2.2. Nothing in these Terms purports to modify or exclude the conditions, warranties, and undertakings, and other legal rights, under the ACL or other laws of Australia. Any and all other warranties or conditions which are not guaranteed by the ACL are expressly excluded where permitted, except to the extent such exclusion is prohibited by law.

3. INTELLECTUAL PROPERTY (IP) RIGHTS

3.1. Government Content: We acknowledge that the core curriculum is based on the Commonwealth of Australia's booklet, "Australian Citizenship: Our Common Bond." We claim no ownership over official government text or public sector information.

3.2. Proprietary Rights: Notwithstanding clause 3.1, the specific arrangement, organization, "Smart Challenge Bank" algorithms, software code, course structure, progress tracking systems, user interface, and the specific phrasing of mock questions on this Site are the exclusive Intellectual Property of Citizenship Test Australia.

3.3. License: We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site for personal, non-commercial educational purposes only.

3.4. Restrictions: You strictly may not:

Scrape, copy, reproduce, or distribute our questions or content for any commercial purpose.
Share your login credentials with others (see Section 6).
Reverse engineer, decompile, or attempt to extract the source code of our testing algorithms.

4. THE "100% PASS GUARANTEE"

4.1. We offer a conditional Money-Back Guarantee to Premium subscribers who fail their official Australian Citizenship Test. This is a contractual warranty limited to the cost of the subscription service.

4.2. To qualify for a refund, you must meet ALL of the following strictly enforced criteria:

Eligibility: You must have held a Premium Subscription for at least 14 days prior to your official test date.
Completion: You must have completed 100% of the revision questions and mock tests available on the platform prior to your test date.
Performance: You must have achieved a score of at least 90% on the designated "Final Mock Exam" (or "Simulation Exam") strictly before sitting the official exam.
Proof: You must provide the official "Not Approved" letter or test result document from the Department of Home Affairs confirming you failed the test.
Claim Window: You must email your refund claim to [email protected] within 30 days of your failed test date.

4.3. This guarantee applies to the subscription fee only and does not cover government application fees, travel, or other costs. It does not apply if you fail to attend your test, are refused citizenship on character grounds, or fail due to not bringing correct ID documents.

5. PAYMENT, CANCELLATIONS & REFUNDS

5.1. Subscriptions: Premium access fees are payable in advance. Prices are in Australian Dollars (AUD) and include GST unless otherwise stated.

5.2. Major Failures (ACL): If our service has a major failure (for example, the site is offline for an extended period, or the content is substantially unfit for purpose), you are entitled to cancel your contract and receive a refund for the unused portion, or compensation for its reduced value.

5.3. Change of Mind: Except for valid ACL claims or the "100% Pass Guarantee" (Clause 4), we do not offer refunds for "change of mind" or if you simply decide not to proceed with your citizenship application.

6. USER CONDUCT & ACCOUNT SECURITY

6.1. Single User License: Your account is for your personal use only. Sharing passwords or allowing multiple people to study from one Premium account is a material breach of these Terms.

6.2. Termination: We reserve the right to suspend or terminate your account immediately without refund if we detect abnormal usage patterns consistent with account sharing, including but not limited to excessive IP address changes or the use of VPNs to mask simultaneous access.

7. GOVERNING LAW & JURISDICTION

7.1. These Terms are governed by the laws of New South Wales, Australia.

7.2. You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia (including the Federal Court) for any disputes arising out of or in connection with these Terms or your use of the Site.

7.3. Use of this Site is unauthorised in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this section.

8. LIMITATION OF LIABILITY

8.1. To the maximum extent permitted by law, Citizenship Test Australia excludes all liability for any indirect, incidental, special, or consequential loss (including but not limited to loss of opportunity, loss of data, loss of anticipated profits, or failure to achieve Australian Citizenship) arising out of your use of the Site.

8.2. While we strive for accuracy, we do not warrant that the content is error-free or that the Site will be uninterrupted.

8.3. Our total liability to you for any claim arising out of these Terms (excluding valid ACL claims for major failures) is limited to the total amount you paid us for the Premium Subscription.

9. MODIFICATION OF TERMS

9.1. We reserve the right to update these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of the revised Terms.
